Laaktaa Logistics – Delivery Partner Policy Agreement
This Delivery Partner Policy Agreement (“Agreement”) sets forth the terms and conditions under which individuals or entities (“Delivery Partner” or “Driver”) are engaged with Laaktaa Logistics (“Company”). By registering with the Company and accepting delivery orders through the Laaktaa Logistics platform, the Delivery Partner hereby agrees to the following:
1. Engagement of Delivery Partner
1.1 The Delivery Partner is engaged on an independent contractor basis. This Agreement does not establish an employer–employee relationship, partnership, or joint venture between the Delivery Partner and the Company.
1.2 The Delivery Partner shall have full discretion in accepting or rejecting delivery requests made available through the Laaktaa Logistics application.
2. Revenue Sharing
2.1 For each successfully completed delivery order, the Delivery Partner shall be entitled to eighty percent (80%) of the delivery fee.
2.2 The Company shall retain twenty percent (20%) of the delivery fee as its service charge.
2.3 The Delivery Partner agrees that all payments shall be processed in accordance with the Company’s accounting and payment cycle.
3. Risk and Liability
3.1 The Delivery Partner acknowledges and agrees that all risks associated with the performance of delivery services—including but not limited to road accidents, theft, loss of parcel, personal injury, or damage to third-party property—shall be borne solely by the Delivery Partner.
3.2 The Company shall not be held responsible for any personal, legal, financial, or third-party claims arising out of the Delivery Partner’s actions or omissions during the course of fulfilling a delivery.
3.3 The Delivery Partner shall be solely responsible for ensuring they possess valid licenses, insurance coverage, and all permits required under applicable law to operate as a delivery driver.
4. Conduct and Compliance
4.1 Delivery Partners shall handle all parcels with due care and ensure timely delivery in accordance with the instructions provided by the customer and the Company.
4.2 Delivery Partners shall comply with all laws, rules, and regulations, including traffic and road safety laws, while carrying out delivery activities.
4.3 Any misconduct, fraudulent activity, or breach of this Agreement may result in immediate termination of the Delivery Partner’s access to the Laaktaa Logistics platform.
5. Termination
5.1 Either Party may terminate this Agreement with prior written notice of seven (7) days.
5.2 The Company reserves the right to suspend or terminate the Delivery Partner’s access to the platform immediately in the event of misconduct, violation of applicable law, or breach of this Agreement.
6. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Bhutan. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Bhutan.
7. Acknowledgement
By onboarding onto the Laaktaa Logistics platform, the Delivery Partner hereby confirms that they have read, understood, and agreed to be bound by the terms of this Agreement.
